Magistrate rules prosecution evidence against Hon Katuta must be challenged in court

LUSAKA, 22 May 2025 – The Lusaka Magistrate Court has ruled that Chienge Member of Parliament Given Katuta must proceed to defend herself against a charge of threatening violence, following a ruling that the prosecution has established a prima facie case.
Magistrate Idah Phiri, delivering the decision, stated that the evidence submitted by the state—if left unchallenged—could result in a conviction.
Hon Katuta has thus been placed on her defence under Section 207 of the Criminal Procedure Code.
The charge stems from an alleged confrontation on 21 July 2023, in which Hon Katuta is accused of verbally threatening and physically confronting Times of Zambia photojournalist Henry Chunza during a parliamentary session.
She has pleaded not guilty and remains on police bond. The court emphasized that she is presumed innocent until proven guilty.
Prosecution’s Case
The state alleges that Hon Katuta, with the support of other parliamentarians, manhandled and spat on Chunza, conduct said to have amounted to unlawful intimidation.
Witnesses, including the complainant, reportedly testified that they heard and saw the MP issue threats and act aggressively.
The prosecution argued that her actions represented not only personal misconduct but also a broader attack on press freedom and journalistic integrity.
Defence Stance
Hon Katuta has strongly denied the accusations, asserting through her legal team that the case is politically motivated and designed to stifle her role as an outspoken opposition lawmaker.
Her lawyers questioned the credibility of the prosecution, citing its failure to present promised video evidence in court.
They maintained that procedural lapses and evidentiary gaps have undermined the state’s argument.
Court Schedule
The matter has been adjourned to 22 August, 29 August, and 1 September 2025 for the commencement of the defence.
Hon. Katuta’s lawyers were granted additional time to prepare and assemble witnesses.
She is expected to begin presenting her side of the case on the scheduled dates.
