UPND blast constitutional Reforms critics
The ruling party reaffirms its commitment to progressive constitutional amendments, stressing democratic values.

Lusaka, Zambia – (23-03-2025) – The United Party for National Development (UPND) has strongly rejected criticism of constitutional reforms and dismissed opposition claims regarding the constitutional review process, reaffirming its dedication to democratic governance, transparency, and public involvement.
In a press briefing, UPND officials, including Frank Bwalya, Director General of the UPND National Media Committee under the Presidential Support Programme, Mark Simuwe, UPND Media Director, and Consultant Oliver Shalala, addressed concerns raised by the opposition, particularly regarding their participation in the constitutional debate.
Refuting Opposition Claims: A Commitment to Fair Governance
Frank Bwalya opened the briefing by rejecting the opposition's allegations of secrecy and manipulation in the constitutional review process.
He stated that the government, under President Hakainde Hichilema, is dedicated to reforms that ensure democracy, fairness, and equality in Zambia’s electoral system.
Bwalya pointed out that several opposition figures, who are now criticizing the reform process, had previously supported the controversial Bill 10, a proposal that was widely viewed as undemocratic.
Bwalya argued that the failure of Bill 10 has led to the current opposition's credibility issues in constitutional matters.
"These criticisms are nothing but political diversion," Bwalya asserted.
"Those now claiming to advocate for democracy are the same people who championed policies that sought to undermine our democratic principles."
OCIDA’s Misrepresentation Clarified
Bwalya also addressed the claims made by the opposition regarding the involvement of the Our Civic Duty Association (OCIDA) in their recent press conference. Some reports had mistakenly identified OCIDA as a participant.
He clarified that Mr. Brebnar Changala, a well-known civil rights advocate, was erroneously linked to the group. After confirming with OCIDA officials, Bwalya assured the public that the organization had no involvement in the opposition's press event.
"OCIDA has no part in this matter," Bwalya stated. "The misinformation is part of a wider effort to mislead the public."
Rejecting Fearmongering and Unfounded Claims
Turning to further allegations from opposition figures, including Dr. Fred M’membe, who claimed that the constitutional reforms could lead to political instability or suppression of freedoms, Bwalya firmly rejected such assertions.
He stressed that President Hichilema’s administration has worked towards enhancing political freedoms and increasing transparency, which stands in stark contrast to the fearmongering tactics of the opposition.
Bwalya also dismissed opposition accusations regarding Zambia’s military and intelligence services, emphasizing that these institutions remain professional and apolitical.
He noted that the government's ongoing development projects, including infrastructure improvements, were indicative of the administration’s commitment to national security and public welfare.
Reaffirming the Legislative Process and Public Involvement
Mark Simuwe, UPND Media Director, addressed the opposition’s concerns about the transparency of the law reform process.
Simuwe explained that amending the Constitution requires the approval of a two-thirds majority in the National Assembly, ensuring that the reforms are thoroughly scrutinized and supported by a broad spectrum of political parties, including the opposition.
He invited critics to present concrete evidence if they believe any irregularities have occurred.
"Any constitutional changes require the approval of the majority of lawmakers," Simuwe emphasized.
"If opposition parties truly seek transparency, they should participate fully in the process rather than make unfounded accusations."
Simuwe also pointed out that many opposition figures had previously participated in public consultations organized by the Electoral Commission of Zambia (ECZ), thus contradicting their current claims of exclusion from the reform process.
He further stated that opposition parties had been informed about the ongoing constitutional discussions and had been offered opportunities to provide input through official channels.
Simuwe challenged the opposition to stop making baseless accusations and focus on contributing to the reform process.
Inclusivity in Constitutional Reforms
Simuwe highlighted the UPND's commitment to ensuring that citizens have a meaningful voice in the reform process. He referred to recent consultations, in which the ECZ collected views from Zambians on electoral reforms.
He also underscored the government’s focus on improving gender representation and ensuring that reforms align with the constitutional principles of fairness and inclusivity.
However, Simuwe acknowledged that some critics continue to argue that the government has excluded them from the process, despite their formal submissions to ECZ. He suggested that this contradiction weakens their position in the ongoing debate.
The Importance of Timely Constitutional Reforms
UPND Consultant Oliver Shalala has rejected allegations that the ruling party’s constitutional reform initiatives are reactionary, instead calling them a part of a well-structured, long-term strategy aimed at enhancing governance.
Shalala emphasized the party’s commitment to transparency, accountability, and inclusivity in engaging the media and the public on national issues.
Constitution as a Living Document
Shalala underscored that Zambia’s Constitution must evolve in response to the country's dynamic needs.
He reminded the public that since Zambia's independence in 1964, constitutional reforms have been a consistent part of the country’s governance to address emerging challenges.
Shalala reaffirmed that the UPND is fully committed to progressive amendments that will advance the democratic and governance framework of the country.
“As the ruling party, we recognize the need for constitutional amendments that will enhance governance. Our approach is centered on inclusivity, transparency, and accountability,” Shalala stated.
He detailed the key areas of reform being considered, such as the introduction of proportional representation, addressing legal gaps related to by-elections, and making provisions for election postponements.
UPND’s Position on Democratic Principles
Shalala also addressed growing concerns and speculations regarding the government’s intentions to amend critical democratic provisions in the Constitution.
He categorically dismissed claims that the UPND seeks to modify fundamental democratic principles, including:
The 50+1 electoral threshold
The running mate clause
The presidential term limit of five years
The two-term limit for the presidency
“We remain committed to implementing only necessary and progressive amendments while upholding constitutional integrity,” he reassured the public, emphasizing that the UPND respects the Constitution’s core democratic principles and does not intend to undermine them.
Constitutional Review and the 2026 Elections
Shalala also responded to opposition leaders who have argued that the constitutional review process is unnecessary before the 2026 elections.
He pointed out that Zambia’s Constitution requires a review every ten years, with the next scheduled revision set for January 2026, as outlined in the 2016 Constitutional Amendment.
“It is important to note that the Constitution mandates a review every ten years. The scheduled review is not optional,” Shalala emphasized, reminding critics that the Constitution acknowledges 156 constituencies.
Therefore, adjustments related to constituency delimitation, as well as provisions for enhancing women’s representation, need to be addressed prior to the elections to ensure an equitable and fair electoral process.
Commitment to Transparency
Shalala reassured the public that the constitutional review process will be open, allowing for input from all stakeholders, including the opposition, civil society organizations, and the general public.
He emphasized that transparency is key to fostering public confidence in the process.
“The opposition may choose to reject this initiative, but the reality is that these amendments are necessary for national progress,” Shalala stated.
“We understand the importance of ensuring every Zambian’s voice is heard, and we will continue to provide avenues for participation.”
He also pointed out that the Ministry of Justice has been consistently updating Parliament on the constitutional reform process, highlighting the government's dedication to keeping the public informed about developments.
Shalala added that President Hakainde Hichilema and the UPND leadership remain committed to informing the public and involving them at each step of the process.
Shalala concluded by reaffirming UPND’s dedication to upholding democratic values, ensuring constitutional integrity, and fostering national development.
He reiterated that the constitutional amendments are part of the party’s vision to create a more inclusive, transparent, and progressive Zambia that works for all its citizens.
Support from UNIP for President Hichilema’s Leadership
In addition to UPND's statements, Alfred Banda, National Coordinator of the United National Independence Party (UNIP), also expressed support for President Hichilema’s leadership.
He emphasized that these policies reflect UNIP's core principles and support the President's vision for Zambia's future.
Meanwhile, the United National Independence Party (UNIP) has expressed full support for President Hakainde Hichilema’s leadership, commending his efforts to create a fairer and more equitable Zambia.
Alfred Banda, the UNIP National Coordinator, praised the President for advancing policies that foster equality and provide equal opportunities for all citizens.
Banda highlighted that under President Hichilema’s administration, Zambia has seen tangible progress in key areas that align with UNIP’s core values, such as job creation, free education, and the Constituency Development Fund (CDF).
These policies reflect UNIP’s longstanding commitment to addressing fundamental societal issues, which are vital to ensuring a prosperous future for the nation.
“The president’s leadership is making a noticeable impact in addressing long-standing challenges. The policies he has championed are rooted in principles that UNIP has always advocated for, particularly in empowering the youth, fostering education, and ensuring that communities are self-reliant,” Banda remarked.
As part of his efforts to illustrate the success of the government’s inclusive policies, Banda shared stories from Shine Zambia, a charity he is involved with, that has educated over 1,000 vulnerable children.
He noted that several of Shine Zambia’s graduates have gone on to achieve notable successes, such as El Escwamba, who is now a Zambia National Service (ZNS) officer, Diana Zulu, who has become a nurse, and Isaac Phiri, who works for the local government in Ndola.
“These individuals, who come from disadvantaged backgrounds in Kanyama Compound, have benefited directly from the government’s inclusive approach,” Banda emphasized.
“Their stories are a testament to the transformative impact of President Hichilema’s policies.”
A key point in UNIP’s advocacy is proportional representation, which has been a cornerstone of the party’s constitutional agenda.
Banda emphasized that UNIP has long campaigned for the implementation of a proportional representation electoral system.
He personally led a UNIP delegation to present submissions for this cause and attended the National Dialogue Forum (NDF), where the issue was discussed.
“We fully support the proposed constitutional amendments and urge the government to expedite the process,” Banda stated. “This is a crucial reform that cannot afford further delays.”
The party also commended President Hichilema’s effective implementation of the CDF, which has significantly improved local communities and promoted decentralization—another key principle in UNIP’s political agenda.
This initiative directly aligns with UNIP’s call for political and economic decentralization, empowering local communities to manage their own affairs.
In a move that reflects the alignment of values between the two parties, UNIP has resolved to enter into a formal alliance with the United Party for National Development (UPND).
Banda confirmed that a ceremony will be held soon to solidify the working relationship, underscoring UNIP’s commitment to supporting President Hichilema’s government.
“In the coming weeks, we expect to formalize our alliance with UPND, marking the beginning of a stronger partnership for national development,” Banda concluded.
“We are committed to working together to create a more inclusive, prosperous Zambia.”
UNIP’s statement calls for immediate action on the proposed constitutional amendments, especially on proportional representation, and reaffirms the party’s commitment to national development, democratic governance, and community empowerment.
